1. Agreement to These Terms

These Terms of Use ("Terms") govern your access to and use of 5050realtygroup.com and any related pages we operate (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

We may update these Terms from time to time. The "Last updated" date above will change when we do, and your continued use of the Site after that date means you accept the revised Terms.

2. Who We Are

The Site is operated by 5050 Realty Group, a real estate brokerage licensed by the Texas Real Estate Commission, Broker License #696804, based in San Antonio, Texas.

Texas law requires that we make certain notices available to you. The TREC Consumer Protection Notice is linked in the footer of every page. We provide the Information About Brokerage Services notice at our first substantive communication with you about a specific property; it is informational and does not by itself create a representation agreement.

3. Using the Site Does Not Make Us Your Agent

The Site is informational. Browsing it, reading a listing, using a calculator, or sending us a message does not create a real estate agency or brokerage relationship between you and 5050 Realty Group, and does not make us your agent or fiduciary.

A brokerage relationship is created only by a written agreement signed by you and by us. Until that agreement exists, we owe you no duty of representation, and you should not rely on anything on the Site as advice given on your behalf.

4. Property Information Is Not Guaranteed

Property details on the Site, including price, availability, square footage, lot size, room counts, taxes, school assignments, HOA information, photographs and descriptions, come from sources we believe to be reliable, including multiple listing services, sellers and third-party data providers. We do not independently verify all of it.

We make no representation or warranty that any property information is accurate, complete or current. Properties may be sold, leased, withdrawn or repriced at any time without notice. Measurements are approximate. You should independently verify every fact that matters to your decision, and we encourage you to use a licensed inspector, surveyor, appraiser and attorney as appropriate.

5. Statements About Our Fees

Where the Site describes our listing fee, that figure is the portion payable to 5050 Realty Group for a resale listing. It excludes new construction. Commission rates are negotiable, are not set by law, and vary by market and by the terms of your written agreement with us.

Any compensation offered to a cooperating broker is separate, is negotiated per transaction, and is not included in the figure shown. Nothing on the Site states a combined commission or guarantees a saving in any specific transaction. Your actual costs are governed solely by the written agreement you sign.

6. Not Legal, Tax or Financial Advice

Content on the Site, including guides, articles, checklists and calculators, is general information for education only. It is not legal, tax, accounting, mortgage, insurance or investment advice, and it is not a substitute for advice from a licensed professional who knows your situation.

Calculator results are estimates based on the figures you enter and on assumptions that may not fit your circumstances. Do not rely on them as a quote, an approval, or a prediction of what any lender, taxing authority or insurer will do.

7. Information You Send Us

When you submit a form, you confirm that the information you provide is accurate and that you are authorized to share it. Do not send us sensitive personal information through the Site, such as Social Security numbers, financial account numbers or government identification.

By submitting a form that requests your phone number, you consent to be contacted by phone, text message and email about your inquiry. Message and data rates may apply. Consent to be contacted is not a condition of any purchase or of any brokerage service. You may opt out at any time by replying STOP to a text, by using the unsubscribe link in an email, or by telling us directly.

How we handle the information you send is described in our Privacy Policy, which forms part of these Terms.

8. Fair Housing

5050 Realty Group supports and complies with the Fair Housing Act and the Texas Fair Housing Act. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other class protected by federal, state or local law.

We will not honor requests to steer, restrict or target listings on any protected basis. If you believe you have experienced discrimination, you may contact the U.S. Department of Housing and Urban Development or the Texas Workforce Commission Civil Rights Division.

9. Acceptable Use

You agree not to use the Site to break the law or to interfere with how it works. Specifically, you agree not to:

• Scrape, harvest, crawl or copy listing data or contact information for any commercial purpose without our written permission;
• Submit false, misleading or automated form entries, or impersonate another person;
• Attempt to gain unauthorized access to the Site, its server, or any connected system;
• Introduce malware, or interfere with the Site's availability for others;
• Use the Site or its content to send unsolicited commercial messages.

10. Our Content

The Site's text, layout, graphics, logos, photographs and video are owned by 5050 Realty Group or used with permission, and are protected by copyright and trademark law. The 5050 Realty Group name and mark are ours.

You may view and print pages for your own personal, non-commercial use. Any other reproduction, distribution, modification or republication requires our written permission. Listing photographs are frequently owned by the photographer, the seller or the listing brokerage, and may carry separate restrictions.

11. Links to Other Sites

The Site links to third parties, including the Texas Real Estate Commission, lenders, inspectors and mapping and analytics providers. We do not control those sites and are not responsible for their content, accuracy, availability, or privacy practices. A link is not an endorsement, and your use of a linked site is governed by that site's own terms.

12. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranty of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site is free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by law, 5050 Realty Group and its owners, agents and employees are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or lost opportunity, arising out of your use of the Site, even if we have been advised that such damages are possible.

Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for fraud or for a broker's statutory duties under Texas law.

14. Indemnification

You agree to indemnify and hold harmless 5050 Realty Group and its owners, agents and employees from any claim, loss, liability or expense, including reasonable attorney's fees, arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or of the rights of a third party.

15. Changes to the Site

We may change, suspend or discontinue any part of the Site at any time, including any listing, tool or page, without notice and without liability to you.

16. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to the jurisdiction of those courts.

If any provision of these Terms is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it.
